These Terms of Service ("Terms") govern your use of ALevellers ("Service," "we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Age Requirement: The Service is intended for Advanced Level (AL) students aged 17 and above. Users under 18 must obtain parental or guardian consent before using the Service.

1. Service Description

ALevellers is an educational platform for G.C.E. Advanced Level students providing MCQ practice, competitive challenges, leaderboards, performance tracking, and supplementary learning materials.

2. Account Registration and Security

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities under your account
  • One account per user; multiple accounts are prohibited
  • Notify us immediately of any unauthorized use at [email protected]

3. Payments and Subscriptions

Free Tier: Limited to 5 challenges per day.

Premium Access: Unlimited challenges via subscription or one-time passes.

  • 30-day money-back guarantee on premium subscriptions (first-time subscribers only)
  • Subscriptions auto-renew unless canceled before the renewal date
  • Access continues until the end of the current billing period after cancellation
  • No refunds for partial periods after the guarantee period

4. User Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on others' intellectual property or privacy rights
  • Harass, threaten, or harm other users
  • Post inappropriate, offensive, or harmful content
  • Use bots, scripts, automated tools, or cheating methods
  • Attempt unauthorized access to the Service or other users' accounts
  • Reverse engineer, decompile, or extract source code
  • Resell, redistribute, or commercialize the Service or its content

5. Anti-Cheating and Fair Use

Cheating includes but is not limited to:

  • Using external resources, search engines, or assistance during timed challenges
  • Sharing answers or colluding with other users
  • Exploiting bugs, glitches, or vulnerabilities
  • Creating multiple accounts to gain unfair advantages
  • Using automated tools, bots, or scripts

Penalties: Violations may result in score invalidation, account suspension, or permanent termination without refund.

6. Public Leaderboards and Data Display

By using the Service, you consent to the public display of your first name, last name, profile picture, district, scores, and rankings on leaderboards. This information is visible to all users and may be shared publicly.

7. Intellectual Property

All content on the Service, including but not limited to questions, explanations, text, graphics, logos, software, and designs, is owned by ALevellers or its licensors and protected by copyright, trademark, and other intellectual property laws.

Limited License: You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes only.

Prohibited Uses: You may not copy, reproduce, distribute, modify, publicly display, sell, or create derivative works from Service content without express written permission.

8. Educational Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

ALevellers is a supplementary educational tool. We:

  • Do NOT guarantee exam results, grades, or academic success
  • Are NOT affiliated with the Department of Examinations, universities, or examination boards
  • Do NOT replace formal education, textbooks, or classroom instruction
  • Make no warranties regarding content accuracy, completeness, or timeliness
  • Reserve the right to modify or discontinue the Service at any time

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • ALevellers is NOT liable for your exam performance, academic outcomes, or educational decisions
  • Our total liability is limited to the amount you paid us in the 12 months prior to the claim
  • We are NOT liable for indirect, incidental, special, consequential, or punitive damages
  • We are NOT responsible for third-party content, advertisements, or external links
  • We are NOT liable for data loss, service interruptions, or technical failures

10. Indemnification

You agree to indemnify, defend, and hold harmless ALevellers, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Violation of these Terms
  • Violation of any laws or third-party rights
  • Content you submit or actions you take on the Service

11. Account Termination

Your Rights: You may request account deletion at any time by contacting [email protected].

Our Rights: We may suspend or terminate your account immediately, without notice or refund, if you:

  • Violate these Terms
  • Engage in fraudulent or harmful conduct
  • Fail to pay fees when due
  • For any reason at our sole discretion

Effect of Termination: Upon termination, your license to use the Service ends immediately. Sections relating to intellectual property, disclaimers, liability, indemnification, and dispute resolution survive termination.

12. Dispute Resolution and Governing Law

Informal Resolution: Before filing any legal claim, contact [email protected] to resolve disputes informally. We will attempt to resolve disputes within 30 days.

Governing Law: These Terms are governed by and construed in accordance with the laws of Sri Lanka, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice within the Service. Your continued use after changes constitutes binding acceptance. If you do not agree, discontinue use and request account deletion.

14. General Provisions

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and ALevellers.

Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

Assignment: We may assign these Terms to a successor entity. You may not assign your rights without our written consent.

No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
